Senator Dodd feels that the upcoming legislation in The Netherlands can function as an example to the other European Union Member States as the Dutch government plans to introduce:

1. A ban on downloading from an illegal source;

2. Site blocking by Internet Service Providers;

3. More legal downloading initiatives (new business models) for consumers.

“We think PIPA will ultimately put American innovators and investors at a clear disadvantage in the global economy,” the letter states. It praises section 512 of the DMCA, which gives online service providers a “safe harbor” from copyright liability if they promptly remove infringing materials. They warn that the PROTECT IP Act will upset the “delicate balance” embodied in this provision.

Congress should not chill investment and reduce incentives to work on private sector solutions. Instead, we encourage Congress to focus on making it easier to license works and bring new, innovative services to market.
