ISP British Telecom to pay costs for blocking website Newzbin2

The judge ruled the costs should be borne by BT with respect to the implementation of the order because, in short:

- BT is a commercial enterprise, which makes a profit from the illegal services of Newzbin2 where copyrights are infringed
- the European directive 2001/31/EC of 22 May 2001 (Copyright Directive) implicitly states intermediaries are chosen to end infringing activities and to bear the costs thereof
- the costs of implementing the order are not disproportionate, and the injunction has been assessed on proportionality in the previous main judgment.

Dutch ‘experts in security’ ISSX.nl hack mail server of Dutch IT journalist Brenno de Winter and are unable to cover their own tracks

Act of revenge as the IT journalist was exposing major security flaws last months, including security issues relating to computer systems of customers of ISSX.nl.

Mistake #1: Reporter Brenno de Winter discovered the hack in a timely fashion

Mistake #2: ISSX.nl did a bad job covering its own tracks

Mistake #3: Unlike the practices of the IT journalist himself, ISSX.nl did NOT proactively inform Brenno de Winter about the security flaw, which would have enabled him to take appropriate measures. In stead they handed the stolen data to a reporter of Dutch newspaper De Telegraaf

Mistake #4: The security flaw did NOT relate to a serious breach of security, but rather a zero-day exploit, unknown to the developers of the mail server software themselves

It is unknown whether the IT journalist Brenno de Winter will go file a criminal complaint for ISSX.nl hacking his server

The City of London Corporation

The City of London Corporation (also known as the Corporation of London) is the municipal governing body of the City of London. It exercises control only over the City (the “Square Mile”, so called for its approximate area), and not over Greater London. It has three main aims: to promote the city as the world’s leading international financial and business centre; to provide local government services; and to provide a range of additional services for the benefit of London, Londoners and the nation.

There is no surviving record of a charter first establishing the corporation as a legal body, but the city is regarded as incorporated by prescription, meaning that the law presumes it to have been incorporated because it has for so long been regarded as such even in the absence of written documentation.

The corporation is unique among UK local authorities for its continuous legal existence over many centuries, and for having the power to alter its own constitution, which is done by an Act of Common Council.
