A pub landlady has won the latest stage of her fight to air Premier League games using a foreign TV decoder.

Karen Murphy had to pay nearly £8,000 in fines and costs for using a cheaper Greek decoder in her Portsmouth pub to bypass controls over match screening.

The ECJ said national legislation, which banned the use of overseas decoders, could not “be justified either in light of the objective of protecting intellectual property rights or by the objective of encouraging the public to attend football stadiums”.

Why is the United States experiencing a drug shortage? It’s mostly a problem for injected drugs, which present unique manufacturing problems. Only about six companies make them. They can become contaminated relatively easily, which often prompts the companies to abandon production. Profit margins are slim. Injectables are harder to produce and take longer to make than pills. Also, there’s no regulation forcing drug makers to report manufacturing issues that might lead to shortages.

According to the site, Twitter is the highest-paying tech company with $120,111.11 as the average salary. Apple ($113,319.21), LinkedIn ($111,720.00), Facebook ($105,167.62) and Google ($104,594.27) round out the top five.

After building the site and posting it to his Facebook wall last week, Jones was floored by the response. He received a call from his hosting company at 4 a.m. a couple nights ago, telling him that his traffic had spiked to abnormal levels.

“I have no idea how everyone found it,” he said, noting the little site has had over 200,000 impressions in the last three days. “I haven’t slept in three days and have used three credit cards buying servers.”

Google remains an impressive company, one that dominates a particular category of the search market. But make no mistake: Google is increasingly losing the larger search battle as it is late to the party in social and other aspects of search. The US Senate, proving that it’s never too late to be behind-the-times, has called Google on the carpet for old news, just as the US government got around to punishing Microsoft for its dominance after it had already lost its hold on the future.

Google may be guilty of many things, but search dominance is no longer one of them, however much the executive team in Mountain View may wish it otherwise.

The BAF Managing Director Christophe van Mechelen acknowledges that DNS blocking regimes can easily be circumvented so he will also

  • take the verdict to the Belgian government and ask for improved takedown procedures as the court proceedings took an entire year;
  • ask for more strict and effective technical blocking procedures.
Van Mechelen is hoping that the other Belgian ISPs will now go and block The Pirate Bay too. He is also thinking of having Megaupload be blocked by Belgian ISPs.
Although both Telenet and Belgacom will not take the case to the Supreme Court, they have stated that any follow up requests by BAF will need to be (re)submitted to court. Belgacom: “BAF is not a law enforcement officer and neither are we. Such procedures will always go through the court system.”
Telenet did add that they are currently also blocking websites containing child pornography and racism.

New study underlines rights concerns with ACTA, strengthens calls for deal to be scrapped.

“As the study points out, encouraging the ‘cooperation’ between internet providers and the content industry amounts to privatised policing, violating the rule of law and the right to fair judicial process. ACTA also allows for the monitoring of internet users without initial suspicion, the handing over of their personal data to rights holders on the basis of mere claims and the transfer of this data even to countries without adequate data protection, all of which is in clear conflict with legal guarantees of fundamental rights in the EU. The agreement does not contain ‘fair use’ clauses or exceptions for trivial or minimal infringements. It therefore tilts the balance – both in terms of substance and of process – unfairly in favour of rights holders and against users and citizens.

“Given the clear fundamental rights concerns with this agreement, the European Parliament should not consent to its ratification. As a first step to this end, the EP should refer ACTA to the European Court of Justice for a final legal opinion (2), before it proceeds with any consent vote, and the Greens will push for this referral to take place later this year.”
