“Banks are in the business of making money, and they find loopholes,” the President said. Apparently forging and fabricating documents to prove ownership of homes that are subsequently stolen from borrowers is now a loophole.
Many of the practices on Wall Street “weren’t necessarily against the law but they had a huge destructive impact,” said the President. The work of Bill Black, the Financial Crisis Inquiry Commission, the Senate Permanent Subcommittee on Investigations, and a host of other official studies, analyses, and even court cases cut against that. Just the other day, a new whistleblower lawsuit against banks for setting illegal fees against military personnel wasn’t joined by the Justice Department.
In a follow-up, the President said that “if somebody they violated laws on the books, they need to be prosecuted, and that’s the Attorney General’s job.” Of course, investigations have to actually be carried out, and the President’s Justice Department has been at the lead of a foreclosure fraud settlement which would bail out banks that would otherwise owe in the trillions for fraudulent practices with the origination and securitization of loans, for a pittance of a sum. Only the work of a few Justice Democrats have put a stop to this.

While many Americans are suffering through an abysmal economy, Internet startups seem impervious to bad news of any kind. Valuations have been rising for several years straight; companies like Zynga, Facebook, and Twitter are minting millionaires left and right; and many young outfits can’t hire skilled, highly paid software engineers or salespeople fast enough.
To get the picture, one only need look to the invitation-only, tequila-fueled industry party that entrepreneur-investor Sean Parker hosted two weeks ago. Split-roasted pigs, Dungeness crabs, and sashimi bars were a mere warm-up to nationally known musical acts like The Killers.

Copyright owners may prohibit the resale of their wares by inserting clauses in their sales agreements. Autodesk had done that with a version of its popular AutoCAD software. The San Rafael, Calif. company sued to enforce those terms in its sales agreement and prevailed.
The Motion Picture Association of America and Software & Information Industry Association, whose members include Google, Adobe, McAfee, Oracle and dozens of others, urged the appellate court to rule as it did.
The American Library Association and eBay argued against that outcome. The library association said it feared that the software industry’s licensing practices could be adopted by other copyright owners, including book publishers, record labels and movie studios.

As a result there are many methods available to circumvent such restrictions (e.g. Proxy Servers, VPN, DNS changes etc.), which are a bit like avoiding the motorway traffic jam by taking an unmarked side road.
Crucially none of these are hard to find, most have legitimate purposes (e.g. VPN) and others are used by millions of people around the world to help them stay in private and largely anonymous contact during times of civil unrest (e.g. Egypt, Libya and Tunisia). Sadly such methods can also be used by criminals, much like motorcars and face masks.
