Conclusion: Most of the half million people following me on Google+ are ciphers. They have signed up, but have not made a single public post, or posted their own image or a profile, or made a comment. They aren’t home. The only place you’ll see people are in the same small set of 100 “recommended” people they follow, of which I am one.

That is why I have half a million followers. Not because I have half a million fans, but because I am on a default list to fill an otherwise empty street when folks sign up.

It starts to become clear that no matter how hard the experts are shouting that current enforcement activities in cyberspace should be placed under legal scrutiny, the 1979 Aliens tagline appears to be true: “In space no one can hear you scream”

People in The Netherlands like Bart Schermer (Dutch language) and Jan-Jaap Oerlemans (Dutch language) have been making a plea for authorities to look into matters such as remote online investigations, hacking and the use of spyware by enforcement authorities.

Even crime fighters like Lodewijk van Zwieten and Wilbert Paulissen (English language) were indicating that they themselves might be engaging in enforcement activities never seen before nor properly backed by any relevant legislation.

One of the reasons for the total silence could be that they’re asking for legislation that will back up online enforcement activities which are already perfectly normal and accepted in other parts of the world. Another reason could be that that their audience (including the ones who are expected to deal with these matters from a public policy perspective) is simply too old and totally detached from the issues they are dealing with. Generally, laws cannot keep up with developments in the area of non-digital crime. Cybercrime is probably moving at the speed of light in the eyes of legislators.

It looks like the use of modern investigational tools and methods will be something that’s going to be tried and tested in Dutch (or other) courts first.

According to a source familiar with the case, the judge’s reasoning in ruling in favor of Partito Pirata was that the Pirate movement is defined worldwide as being critical of copyright and seeking its reform. The ‘fake’ Pirate Party do not so they are not even conforming to the identity they’re trying to ‘kidnap’.

In his ruling the judge ordered the ‘fake’ Pirate Party and Marco Marsili to cease using the name Partito Pirata, Pirateparty or Pirate Party, on- or offline. The use of the name in a domain name is also banned. The group is further forbidden to use the official Partito Pirata logo and has 15 days to comply or face fines of 500 euros per infraction and 200 euros per day for non-compliance.

But the strange story doesn’t end there. According to Partito Pirata founder Athos Gualazzi, the attack on his Party’s identity has sinister toots.

“From the very beginning there has been an attempt to distract from our political experience by people we believe to be paid by the SIAE and the majors,” said Gualazzi. SIAE are the Italian Authors and Publishers Association, an organization responsible for the protection of copyright in Italy.

As well as being the individual behind the ‘fake’ Pirate Party, interestingly Marco Marsili is also the president of the Confederation of Italian Music, a trade group representing record producers, publishers, authors and artists. According to his personal site, Marsili claims to have “signed major contacts” with, among others, SIAE.

Slippery Slope Religion Prevents Dealing With One Crime Out Of Fear Of Having To Deal With Other Crimes Too

Wikipedia has plenty of problems—mostly stemming from being synonymous with online misinformation. But Jack Stuef over at FWD took a deeply disturbing look at one issue you might not expect: Wikipedia’s admins willfully refuse to remove child porn, and there’s almost nothing you can do to remove it yourself.

Stuef ran into the situation after running into an image of a boy’s penis on the site. He tried to contact an admin, but hit a bureaucratic brick wall. Which is shocking enough, but even more so when you consider Wikipedia’s history on the matter. Even founder Jimmy Wales was shouted down by the militantly-free-speech userbase after he deleted some kiddie porn photos.

Groupthink Web spaces have been notoriously slow to ban kiddie porn. Reddit’s jailbait section was defended fiercely, and only finally closed on the technicality that one of its moderators totally lost his shit. When it comes to crowdsourced, explicitly-sexual underaged images, it seems you’ve got to go after Capone’s tax records.
